These Terms of Use govern your use of the Where Is The Photobooth website ("the site"), operated by Where Is The Photobooth ("we", "us"), a vintage photobooth rental business based in New York City. By using this site — including submitting the email signup form — you agree to these terms. If you don't agree, please don't use the site.

What this site does

The site lets you join an email list to hear where the photobooth will pop up next, and provides general information about our rental services. Signing up for the email list is free and creates no booking, reservation, purchase, or contract for services. Any rental is arranged separately and governed by its own agreement.

Acceptable use

You agree not to:

• Use the signup form for spam, harassment, or fraudulent purposes, including submitting email addresses that aren't yours.
• Attempt to disrupt, probe, or overload the site or its infrastructure, or bypass its security measures.
• Scrape, copy, or reuse site content for commercial purposes without our permission.
• Misrepresent the site or our services, or impersonate us.

We may block access or remove signups that violate these terms.

Email communications

By signing up, you consent to receive emails from us — a confirmation message and announcements about upcoming pop-ups. You can unsubscribe at any time using the link in any email, or by contacting us. How we handle your information is described in our Privacy Policy.

Intellectual property

The site's content — including its name, branding, text, imagery, and design — belongs to Where Is The Photobooth or its licensors and is protected by intellectual property law. You may view and share links to the site, but you may not reproduce or reuse its content without permission.

Third-party services

The site uses Google reCAPTCHA to protect the signup form from abuse; its use is subject to the Google Privacy Policy and Terms of Service. The site also links to our Instagram profile — your use of Instagram is governed by its own terms.

Disclaimers

The site is provided "as is" and "as available" without warranties of any kind, express or implied. We don't warrant that the site will be uninterrupted, error-free, or that pop-up announcements will meet every expectation. Event details shared through the list may change.

Limitation of liability

To the fullest extent permitted by law, Where Is The Photobooth is not liable for any indirect, incidental, or consequential damages arising from your use of the site or the email list. Our total liability for any claim related to the site is limited to the amount you paid us to use it — which is zero.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising from the site will be resolved in the state or federal courts located in New York County, New York.
